expert. she is here now with more. justine.? >> reporter: we are now in the middle of flu season. and by all indications it is worse than last year. let's get right to the new numbers. centers of disease control just put out the data from last week. a total of 47 states reported "widespread" flu activity. that is down from 48 last week. the report also found "high levels" in 26 states -- a decrease from the 30 reported last week. here is california we are in the high category. finally, 37 children have died from the flu this season. at this point flu vaccine may be harder to find. you may need to contact more than one provider to find available vaccine. also. bad cases of the stomach flu are now going around.we'll talk about that coming up tonight at six.

>> the alameda district said that they had *no choice but to shoot a man. this is video from our helicopter partnership with abc-7 news. all this happening about 9- am, on fredericksen lane. investigators say, a concerned father called 9-1- 1 for help. because his 28- year-old son was acting in a bizarre manner >> within two minutes, he was already out of the house charging police. the deputy fired struck the suspect and the suspect was able to take him... peter was able to take the suspect into custody >> pam: a lone deputy from the alameda county sherrif's office. was the first to arrive on the scene investigators say, the man who was shot is expected to survive. and it's not the first time they have had to respond to distrurbances involving the same person. >> serious charges could now be ahead for a teenager accused of unrelentingly bullying two younger school- mates. kron4's rob fladeboe walks us through how police say it all unfolded.

>> reporter: morgan hill police were back on campus here at britton middle school on friday. they now say a 14-year-old student will face charges of battery in addition to on- >> he displaced a gun towards a gun and also he another shot a another teenager with the air gone. >> reporter: air--a- gun...air gun..police say the air soft shooting occurred after the boy had been warned by the school resource officer to lay off a pair of 13-year old being wanted the younger boys to smoke marijuana with him. >> once he refused, he started bullying them to try to change their mind. >> reporter: later that night, after a 2nd warning by both police and school officials, the 14-year-old continued the bullying by sending threatening text messages to the younger boys cell phones and posted

similar threats on facebook. the school is now working to identify any other possible victims of the bullying. a statement that went out to all britton parents.the district says it's working with law enforcement called the incident.'an opportunity for parents to remain aware of your student's activity around town and on-line.' facing battery, making harrassing phone calls and other charges, former prosecutor and legal analyst steven clark tells kron 4 news the 14-year-old could ultimately spend time in juvenile hall and be expelled from school. clark says both the courts and schools have little tolerance these days for any kind of bullying. in morgan hill rob fladeboe kron 4 news >> catherine: apple is ending the week as a runner- up. the cupertino-based company was surpassed today by exxon - as the world's most valuable company. the stock has been on the decline since the quarterly earnings report came out wednesday. it suggests that apple's fast growth phase may be coming to an end. the stock fell 2.4%

today.following a 12% drop thursday. on the other hand -- don't cry for apple. its products are still flying off shelves. >> pam: a morgan hill man now facing charges in the molestiion of four children. this is the suspect -- 65- year-old miguel delgado. investigators say they found evidence at delgado's home, linking him to the crime. >> a candlight-walk planned to mark the annivesary of a long-missing dublin child. 13 year old ilene misheloff vanished on the way home from school 24 years ago. the candlelight walk will be on january 30th and will start at 7 p-m at wells middle school. they will walk the path taken by ilene the day she disappeared. >> catherine: freezing weather is causing big problems across much of the country tonight. including major accidents. that's at 5:30. >> pam: but first, what is your name worth to you? kron4 talked to the man who

this snowfall tonight in washington d.c. may be pretty. but the wintry weather is still causing huge problems for much of the northeast and midwest. and beyond. at least 4 people have major traffic problems. catherine heenan is here with the story. >> catherine: one of those traffic problems was earlier tonight in colorado. the driver of a tanker full of diesel fuel went off a very icy road - into a ditch. highway patrol officers in several states say they have their hands full with snow and ice. as for the tanker -- you san see what's left of it. it caught fire and8-thousand gallons of fuel spilled. the stormy weather has been moving into the south. icy roads in tennessee also made driving very dangerous. nashville. there were lots of accidents. there have also been delays and cancellations today for air travelers. including at the nashville airport - where all inbound american airline flights were canceled. it's not just accidents. the icy, snow covered roads are slowing the delivery of everything from groceries to mail. this is kentucky.where some highways were shut down. there have also been a lot of reports of people and

animals falling through ice. special coast guard teams have been doing extra training to deal with that. bitterly cold conditions could last through the weekend in many places. and look how tough it was for some students in provo, utah to get around today. just getting from one class to another was a challenge. the ice here made it very difficult to walk. a thick sheet of frozen rain had people hanging on to handrails or walls. or sliding along. the film student who shot this video says this kind of ice was covering the whole >> jacqueline: the problem with this is that it was not the long ago towards the eastern united states with cold temperatures. even teens. a lot of snow over the east coast and the chicago. fade dangerous

cloud patterns offshore. with more showers near the coast. and also indicating cold temperatures. it is coming out from the gulf of alaska. spot a shower activity but some areas hit or miss. keeping the umbrella handy but you will notice partly cloudy skies and mostly sunny for the weekend. showers here, there. the dry, warm weekend will continue. however, by 8:00 p.m., still the possibility of lingering showers otherwise, dry conditions returning to the northward just some areas of the very light rain and that is it. we will start to see the clouds of decreasing. mostly clear skies but again, the possibility of shower activity saturday night. and
